Terms and Conditions of the Online Store GoldenShark.pl

The following Terms and Conditions define the rules and conditions for using the online store at www.goldenshark.pl, the procedure for concluding distance sales contracts with customers of the store, both consumers and business entities, in accordance with the provisions of the Act on Providing Services by Electronic Means, the Act on Consumer Rights, the Civil Code, the Act on Personal Data Protection, as well as guidelines derived from the European Union legislation pertaining to the matters addressed herein.


I. General Provisions

  1. The owner of the Store is Marcin Micuła GOLDENSHARK, with its registered office in Brzeg (49-300), at ul. Wileńska 40/12A, a registered VAT taxpayer with the tax identification number (NIP): 9691334405 and statistical number (REGON): 160222736.
  2. GoldenShark.pl is an online store offering sales of equipment and accessories related to mineral exploration. The store's offerings include sluice boxes, sieves, custom-made specialist rubber mats, pans, screens, pumps, and accessories, both custom-made and ready-made. The categories listed on the website are illustrative and not exhaustive. Any expansion of the store’s assortment will be announced on the website.

  4. Through the Store, the Seller provides the following services:
    1. Displaying the Store’s assortment,
    2. Selling Products,
    3. Managing Customer Accounts.
  5. Technical Requirements for the proper functioning of the Store:
    1. A device with Internet access;
    2. A web browser supporting JavaScript and cookies;
    3. An active email account for placing orders.
  6. The Customer is obliged to use the Store’s services in accordance with the applicable laws of the Republic of Poland, these Terms and Conditions, and to refrain from providing content prohibited by law.

II. Definitions

  • Account (Customer Account): A section of the Store where the Customer can manage personal data, track orders, and place orders after logging in.
  • Consumer: A natural person entering into a contract with the Seller not directly related to their business or professional activity.
  • Seller: Marcin Micuła GOLDENSHARK, ul. Wileńska 40/12A, 49-300 Brzeg, NIP: 9691334405, REGON: 160222736.
  • Customer: A natural person, including a Consumer, at least 18 years old, a legal entity, or an organizational unit with legal capacity placing an order or using other Store services.
  • Entrepreneur: A legal or natural person conducting business activity in their own name who uses the Store.
  • Store: The online store operated at www.goldenshark.pl, where Customers can place orders and use other services.
  • Terms and Conditions: This document, acting as the regulation of electronic services under Article 8 of the Act on Providing Services by Electronic Means.
  • Distance Contract: A contract concluded with the Customer within a structured system for distance contracts (Store) without the simultaneous physical presence of the parties, using exclusively remote communication means.
  • Registration Form: A one-time and free action where the Customer creates a Customer Account.
  • Order Form: An interactive form available in the Store that allows placing an order, specifying delivery, and payment details.
  • Order: A declaration of intent by the Customer to enter into a Sales Contract specifying the type and quantity of Products.
  • Cart: A software feature of the Store where the selected Products and their quantities are visible.
  • Product: A movable item or service available in the Store subject to the Sales Contract.
  • Price: The value expressed in PLN, including VAT, which the Customer pays for the Product.
  • Sales Contract: A contract of sale within the meaning of the Civil Code concluded between the Customer and the Seller using remote communication means.
  • Act: The Consumer Rights Act of May 30, 2014 (Dz. U. 2014, item 827).
  • Civil Code (CC): The Civil Code Act of April 23, 1964 (Dz.U.2016, item 380).

III. Creating an Account

  1. Creating an Account is not required to browse the Store’s assortment or place an order.
  2. Registration involves filling out the Registration Form, including an email address and optionally a phone number.
  3. Creating and using an Account is free and available indefinitely.
  4. Logging into the Account requires a login (email or phone number) and a password set during registration.
  5. The Customer must ensure the accuracy of their personal data during registration.

IV. Shopping in the Store

  1. Prices displayed in the Store are in Polish zloty (PLN) and include VAT.
  2. The total order value includes the price of the Products and shipping costs.
  3. Products are added to the Cart.
  4. The Customer selects the delivery method and payment method and provides the necessary information for order fulfillment.
  5. Orders are confirmed upon acceptance of the Terms and Conditions.
  6. The Seller confirms order acceptance via email, which concludes the Sales Contract.

V. Payment and Delivery

  1. Payment methods:

    3. Online payments via Przelewy24, including card payments.
  2. Orders are delivered only within Europe via DPD Polska courier service.

VI. Right of Withdrawal for Consumers

  1. Consumers have 14 days to withdraw from the contract without giving any reason.
  2. Products must be returned to the Seller’s address:
    GOLDENSHARK, ul. Wileńska 40/12A, 49-300 Brzeg, Poland.
  3. The Customer bears the return shipping costs.

VII. Complaints and Returns

  1. The Seller is responsible for delivering Products free of defects.
  2. Complaints can be submitted via email at poczta@goldenshark.pl or in writing.
  3. The complaint must include proof of purchase and a description of the issue.
  4. Defective Products must be returned to the Seller’s address.

VIII. Final Provisions

  1. The Store reserves the right to update these Terms and Conditions.
  2. Customers will be informed of changes via the Store’s website.
  3. The governing law is Polish law.
